PROTOCOL OF NEGOTIATED OUTCOMES

Protocol of Negotiated Outcomes for the Introduction of a New Salary System in Universities

This Protocol between the Ministry of Education and the Public Sector Negotiating Commission (JUKO), the Trade Union for the Public and Welfare Sectors (JHL) and the Confederation of State Employees (Pardia) was signed on  the 16th of December, 2005.

1 § Agreement on negotiated outcomes
The parties reached a negotiated outcome on the new Collective Agreement for State Civil Servants and Employees Under Contract relating to a new salary system for universities (hereafter described as ‘the collective agreement’) and signed a related protocol.  Both documents are enclosed as Appendices to this Protocol. The parties further agreed to additional issues reported later in this Protocol.

2 § The cost impact of this agreement
The increase in overall university salaries which flows from this negotiated agreement is to be 7.24 per cent.   The job demands and personal work performance salary components  should be assessed by
the 15th of April, 2006 following the procedure stated in 4 § and 5 § in the ‘collective agreement’. The cost impact is to be recalculated based on the assessments and the salaries according to the methodologies used the old salary system, as at March 2006.  Should the cost impact of this recalculation be other than 7.24 per cent, the parties will negotiate salary levels for this negotiated agreement so that the cost increase impact is re-established at 7.24 per cent. 

In the negotiations for the ‘collective agreement’, there must be agreement on both the level of salaries, and on the proportions of each salary component.   Resolution should be reached by no later than the 31st of May, 2006

3 § ‘Savings’ in guaranteed salaries caused by terminations of employment
In calculating the level of salaries referred to in the previous paragraph, any ‘savings’ in guaranteed salaries caused by terminations of employment will be taken into account.

4 § Postponing the ‘eurofication’ of salaries
The effect of regulations in 7 § and 8 § of the ‘collective agreement’ made on the 14th of  December 2004, concerning the implementation of new centralised salary systems in public administration, will be postponed from the beginning of December 2005 until the 30th of  June,  2006.  The precondition for the implementation of this paragraph is that a central collective agreement be reached, based on the outcome of bargaining discussions concluded on the 29th of November, 2005.

5 § Delivering statistical data
According to 9 § 2 in the ‘collective agreement’, the parties of the agreement and major union representatives, and other union representatives have the right to receive confidential statistical information.   The statistical information includes (among other things) data   on how the personnel covered by this agreement have been ranked on the job demands and personal work performance components.  This information has to be provided annually, during the implementation and transition phases stipulated in 7 §, and before negotiations concerning salaries. 

The parties will clarify any legal preconditions which might exist in terms of the content and detail of information which can be supplied, and will negotiate by no later than the 20th of January, 2006 about possible modifications required to 9 § 2.

6 § The position of   union representatives and the occupational health and safety representatives
The grounds for the determination of the union representatives’ and occupational health and safety representatives’ salaries will be agreed upon as part of the UPJ-system negotiations by the 31st of January, 2006.  Existing agreements for remuneration will be revised by the 30th of June, 2006, in order to ensure uniformity with salary system reforms.

7 §   Working conditions for assessment groups
The parties to these negotiations presume that universities agree to provide appropriate working conditions for members of assessment groups

8 § The effect on other agreements
These negotiations relate only the new salary system for universities and are not meant to change any other terms for employment under the ‘collective agreement’
